Guidelines for Roll-Off Container Markings

Parking of Roll-Off Dumpsters or Roll Off Containers

N.J.S.A. 27:5I-1
The above-referenced New Jersey Statute applies only to those "roll-off dumpsters" or "roll-off containers" that are placed or parked on roadways or along any highway or along any public property.

Purpose

To warn operators of vehicles traveling on public property that they are approaching parked roll-off containers, which require them to exercise unusual care in the operation of their vehicles.

To promote traffic safety on highways or public property.

Compliance

Must have written consent to park or leave unattended roll-off dumpsters or roll-off containers on or along any highway or public property.  Note: Written consent must be obtained from appropriate municipal, county or state authority having jurisdiction over the highway or public property in question.

Display of yellow reflective diamond-shaped markers/panels with a minimum size of 18 inches by 18 inches.  Marker/panels must be mounted at both ends of dumpsters or containers nearest the path facing oncoming traffic.

Mount marker/panel at the upper end of dumpster or container leaving a minimum height of 3 feet clear distance between bottom of marker/panel and bottom of roadway surface.

Penalties

Violation of this statute carries a fine of not more than $100.00 per violation.

If there is a default on payment of the fine, then imprisonment in the county jail may be imposed for a period of not more than 90 days.

Chapter 51 - Unattended Dumpsters

Section 27:5I-1 

Roll off dumpsters and containers:  consent to park or leave unattended along highway or public property; markers for warning; penalties 

a. No person shall park or leave unattended any waste or refuse container, commonly known as a roll-off dumpster or roll-off container, on or along any highway or public property without the written consent of the appropriate municipal, county or State authority having jurisdiction over the highway or public property.  Consent shall be valid and remain in effect for a period of not more than 30 days, but may be renewed by the appropriate official upon application therefore.

To warn the operators of vehicles of the presence of a traffic hazard requiring the exercise of unusual care, any roll-off dumpster or roll-off container parked on or along any highway shall be equipped with and display markers consisting of all yellow reflective diamond-shaped panels having a minimum size of 18 inches by 18 inches.  These panels shall be mounted at the edge of the dumpster or container at both ends nearest the path of passing vehicles and facing the direction of oncoming traffic.  These markers shall have a minimum mounting height of three (3) feet from the bottom of the panels to the surface of the roadway.

b. A person who is convicted of a violation of this section shall pay a fine of not more than $100.00 for each violation.  In default of the payment of a fine, imprisonment in the county jail for a period of not more than 90 days may be imposed.

The fine shall be paid over to the board or body charged with the maintenance of the road or highway upon which the violation occurs.

Go-Peds are Illegal

Go-Peds are considered motorized vehicles under current motor vehicle regulations, therefore, they must be registered and insured and ridden by a licensed driver.  The State of New Jersey is in the process of passing new legislation specifically prohibiting the use of Go-Peds on any street or highway.  Until that time, officers will enforce the motorized vehicle laws currently listed in Title 39.  Do not let your children ride Go-Peds on any street or highway.  The Go-Ped will be impounded at your expense and summonses may be issued.
